This determination considers the authority’s decision to withdraw a notice to fix for a contravention of section 17. The matter relates to construction of a shed in 2019 and compliance with the clause C3.7 of Building Code.

Decision

In accordance with section 188 of the Building Act 2004, the Ministry of Business, Innovation and Employment determines that there were grounds to issue the notice to fix.

However, as the notice to fix had expired and could not be ‘withdrawn’ because it was no longer in effect, the Ministry elects to neither confirm, reverse nor modify the decision.
