This determination considers the authority’s decisions to refuse to issue a code compliance certificate for alterations to a house and to refuse to issue a certificate of acceptance in relation to the construction of a lean-to.

Decision

In accordance with section 188 of the Building Act 2004, it has been determined:

  1. The authority’s reasons for refusing to issue the code compliance certificate in relation to building consent BC220095 did not meet the requirements of section 95A(b). Therefore the authority's decision has been reversed, and it is for the authority to make a new decision taking into account the findings in this determination.
  2. The authority’s reasons for refusing to issue certificate of acceptance CA240035 did not meet the requirements of section 99A(b). Therefore the authority's decision has been reversed, and it is for the authority to make a new decision taking into account the findings in this determination.
