This determination considers whether a body of water is a residential pool for the purposes of the Act, and so whether it must have a pool barrier that complies with the Building Code to the extent required by section 162C of the Building Act.

Decision

In accordance with section 188 of the Building Act 2004, it has been determined that the body of water on the owners’ property is not a pool for the purposes of the Act and therefore, a barrier is not required by section 162C of the Act to comply with the Building Code.
