Description

This determination considers the authority's decision to issue a notice to fix for siteworks carried out on 16A, 16B and 16C Gilfillan Street.

Decision

In accordance with section 188 of the Building Act 2004, it was determined that the sitework associated with the consturction of the retaining wall was not in breach of clause B1.3.6 at the time the notice to fix was issued, and therefore the authority's decision has been reversed.
