Description
This determination considers an authority’s exercise of power of decision to refuse to grant a building consent for proposed alterations of an existing building.
The determination considers the reasons given by the authority for the refusal, including the requirement for a peer review of the earthquake strengthening element of the building work.
Decision
In accordance with section 188 of the Building Act 2004, it was determined the reasons for the authority's refusal to grant building consent were not sufficiently explicit, specific, or clear information provided by the building owner.
The authority's decision not being reversed, because the owner has already applied for a new building consent.
