This determination arises from the decision of the authority to refuse to issue a code compliance certificate for 3 to 9-year old alterations and additions to a house because it is not satisfied that the building work complies with certain clauses of the Building Code (First Schedule, Building Regulations 1992).

The matters for determination are:

  1. Whether the surface water and foul water drainage systems, as installed in the alterations, comply with Clause E1 Surface Water and Clause G13 Foul Water of the Building Code;
