Description
This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 14-year-old extension and alterations to a house ('the alterations').
The refusal arose because the authority is not satisfied that the building work complies with certain clauses of the Building Code (First Schedule, Building Regulations 1992); in particular in regard to the weathertightness of the claddings, given the age of the alterations.
The matter to be determined is therefore whether the authority was correct to refuse to issue a code compliance certificate for the reasons given in its letter dated 24 May 2012. In deciding this matter, the following were considered:
- Whether the external building envelope of the alterations comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code that was in force at the time the consent was issued;
- Whether other items identified by the authority comply with relevant Building Code clauses, namely Clauses E1 Surface Water, E3 Internal Moisture, G11 Gas as an energy source, G12 Water Supplies and G13 Foul Water.
