Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 21-year-old house, because it was not satisfied that the building work complied with certain clauses of the Building Code (First Schedule, Building Regulations 1992) due to a lack of inspections.

The matter to be determined is therefore the authority's exercise of its powers of decision in refusing to issue the code compliance certificate for the house. In deciding this matter, the following has been considered:

  • (a) Whether the external building envelope of the house complies with Clause B2 Durability and Clause E2 External Moisture of the Building Code that was in force at the time the original consent was issued;
  • (b) Whether other items not passed during inspections comply with relevant Building Code clauses: namely Clauses B1 Structure, E3 Internal Moisture, G12 Water Supplies, G13 Foul Water and H1 Energy Efficiency;
  • (c) The manner in which the authority exercised its powers of decision, with regard to the grounds on which it based its decision.
