Description

This determination arises from the decision of the authority to refuse to issue a certificate of acceptance for remedial building work that had been done without building consent first being obtained.

The matter to be determined therefore is the authority's exercise of its powers of decision in refusing to issue a certificate of acceptance.

In making this decision It must be considered whether there was sufficient information for the authority to be satisfied, to the best of its knowledge and belief and on reasonable grounds, that, insofar as it could ascertain, the building work complied with the relevant clauses of the Building Code (First Schedule, Building Regulations 1992).
