Description

This determination arises from a dispute between the parties about the construction of a one-year-old house and the decision of the authority to issue the original building consent for the house.

The matters to be determined are whether the authority's decision to issue the original consent for the building was correct, and whether the building as constructed complies with the Building Code.

In making the decision, it must be considered whether the documentation submitted for the original consent provided reasonable grounds for the authority to be satisfied that the building would comply with the Building Code if built in accordance with those documents.
