Description

This determination arose from a dispute between the parties about the application of section 112 of the Act, and the authority's refusal to accept the applicant's proposed fire alarm system as complying with the Building Code to the extent required by the Act.

The authority's statement that it considered the proposed alterations did not meet the requirements of the Building Code was taken as indicating its refusal to grant consent.

The matters determined were therefore:

  1. whether the proposed building work complied with Clauses C1 to C6, and F7 of the Building Code to the extent required by the Act;
  2. whether the authority correctly exercised its powers of decision when it refused to grant the building consent.
