Description

This determination arises from a dispute between the parties as to which Acceptable Solution (C/AS1 or C/AS2) applies to the proposed building work for the purposes of achieving compliance with Clause C of the Building Code.

The owner is of the view that the proposed building work falls within Risk Group SH, and that therefore C/AS1 applies.

The authority's view is that the proposed building work falls within Risk Group SM and that C/AS2 applies; for this reason the authority has refused to grant building consent.

The matter to be determined is whether the proposed building work complies with Clause C of the Building Code and whether the authority was correct in its refusal to grant the building consent.
