Scope

This determination arises from the authority's refusal to issue a code compliance certificate for a relocated house. The authority is of the view that some of the building work does not comply with the building consent and does not comply with certain clauses of the Building Code (First Schedule, Building Regulations 1992).

The matter to be determined is whether the authority correctly exercised its powers when it refused to issue a code compliance schedule for the relocated house.

In making this decision I must also consider whether the completed building work complies with the relevant provisions of the Building Code.
