This determination arises from the authority's decisions to refuse to issue a certificate of acceptance and to issue a notice to fix. The authority is of the view that the building work does not comply with certain clauses of the Building Code. The matter to be determined is, therefore, whether the authority correctly exercised its powers in refusing to issue a certificate of acceptance and in issuing a notice to fix. In making this decision, I must also consider whether the completed building work complies with the relevant provisions of the Building Code and whether building consent was required.
