This determination arises from the decisions of the authority to refuse to issue a code compliance certificate and to issue a notice to fix for the 12-year-old house because it was not satisfied that the building complies with certain clauses of the Building Code. The matter to be determined is whether the authority was correct in its decisions to refuse to issue a code compliance certificate and to issue the notice to fix. I note here that there is no record of the authority giving notice of its refusal to issue a code compliance certificate under section 95A; however I take it that the issue of the notice to fix has, to the applicants, effectively been notice of that refusal.
