Description
This determination arose from the decision of the authority to refuse to issue a code compliance certificate and to issue two notices to fix for a 10-year-old house because it was not satisfied that the building work complied with certain clauses of the Building Code.
The authority's concerns regarding compliance related to the weathertightness of the claddings. The matter to be determined was therefore whether the authority was correct in its decisions to refuse to issue a code compliance certificate and to issue the notices to fix for the house.
In deciding this, the following was considered:
- Whether the external claddings complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code that was current at the time the consent was issued, along with any structural implications (Clause B1) associated with weathertightness.
- Whether other items identified in the notices to fix complied with relevant clauses of the Building Code that was current at the time the consent was issued: namely Clauses E1 Surface Water and E3 Internal Moisture.
