Description

The authority issued a code compliance certificate for a 5-year-old house in 2008. This determination arises because the owner claims that the authority failed to ensure the building work complied with relevant clauses of the Building Code. The matter to be determined is therefore whether the authority correctly exercised its powers in issuing a code compliance certificate for the house. In deciding this matter, I must consider: 1-whether the external building envelope of the building complies with Clause B2 Durability, Clause E2 External Moisture and other relevant clauses of the Building Code. The building envelope includes the components of the systems (such as the wall and roof claddings, the windows, the decks and the flashings), as well as the way the components have been installed and work together; 2-whether various other elements in the building, as identified by the parties, comply with the relevant clauses of the Building Code. This determination does not consider other disputed contractual matters relating to this house.
