I take the view that the matter to be determined is whether the authority correctly exercised its power when it imposed section 36(2) notifications under the Building Act 1991 requiring an entry on the certificate of title on 7 lots. I note that the application for determination was made in respect of 19 properties on 14 lots within the subdivision; however the authority has sought to record notifications on only seven lots in the subdivision.
