Description

This determination arises from the authority's decision to refuse to issue a code compliance certificate. The authority's concerns relate to the fact that the building work was carried out under the supervision of Nationwide Building Certifiers, which was duly registered as a building certifier under the Building Act 1991 (the former Act), but which ceased operating as a certifier before it had issued a code compliance certificate for the building work. The matter to be determined is therefore whether the authority correctly exercised its powers in refusing to issue a code compliance certificate. In making this decision, I must consider: the grounds on which the authority based its decision to refuse to issue the code compliance certificate, and whether the decision to refuse to issue the code compliance certificate was correct. In making this decision, I must also consider whether the completed building work complies with the relevant provisions of the Building Code that was current at the time the building consent was issued.
