Description
Regarding the refusal to issue a code compliance certificate for a 15-year-old house at 285 Lawford Road, West Melton, Christchurch
Scope
This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 15-year-old house, because it was not satisfied that the building work complied with certain clauses of the Building Code (First Schedule, Building Regulations 1992).
Concerns about compliance of the house primarily related to its age and to the weathertightness of its claddings.
The matter to be determined was whether the authority was correct to refuse to issue a code compliance certificate.
In deciding this, it was considered:
- Whether the building work complied with the clauses of the Building Code relevant to this house that was current at the time the building consent was issued;
- Whether the building elements complied with Clause B2 Durability of the Building Code, taking into account the age of the house.
