Description

This determination arises from the decision of the authority not to issue an amended building consent for alterations and additions to an existing administration building unless the proposed lift size was increased. The matter to be determined is whether the authority was correct in its decision to refuse to issue an amendment to the building consent. In taking this view, it must also be considered whether the lift that is proposed to be installed in the building is required to comply with the access for persons with disabilities provisions of Clause D1Access routes of the Building Code (Schedule 1 of the Building Regulations 1992).
