Description

This determination arises from the decisions of the authority: to issue a notice to fix for the partly completed house because it was not satisfied that the building work complied with certain clauses of the Building Code and to refuse to accept that the consultants proposals for addressing items identified in the notice (the proposed repairs) will be sufficient to achieve compliance with the Building Code. The matters to be determined are therefore: 1-Whether the authority was correct in its decision to issue the notice to fix; 2-Whether the proposed repairs and completion of the building work will result in the building work complying with Clauses B1, B2, and E2 of the Building Code.
