Description

This determination arose from the decisions of the authority to refuse to issue a code compliance certificate and to issue a notice to fix for alterations to a house because it was not satisfied that the work complied with certain clauses of the Building Code because the new wall cladding was not installed in accordance with the building consent.

The authority's concerns related to the weathertightness of the window junctions.

The matter to be determined was whether the authority was correct to refuse to issue a code compliance certificate.

In making this decision, it was considered whether the altered window junctions complied with Clause B2 Durability and Clause E2 External Moisture of the Building Code to the extent required by the Act.
