Description

This determination arose from the decision of the authority to refuse to issue a code compliance certificate for an 8-year-old outbuilding because it was not satisfied that it complied with certain clauses of the Building Code.

The matter determined was whether the authority was correct to refuse to issue a code compliance certificate.

It was be considered:

  1. Whether the external cladding to the garage/sleepout complied with Clauses B2 Durability and E2 External Moisture;
  2. Whether the sleepout bathroom complied with Clause E3 Internal Moisture;
  3. Whether the elements that make up the building work complied with Clause B2 Durability, taking into account the age of the building.
