This determination arose from the decision of the authority to refuse to issue a code compliance certificate for a 7-year old garage because reasonable progress had not been made in respect of the time taken to construct the building.

The matters to be determined were:

  • whether the authority was correct to refuse to issue a code compliance certificate; and
