Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate and to issue a notice to fix for a 14-year-old house because it was not satisfied that it complied with certain clauses of the Building Code.

The matters to be determined are therefore whether the authority's decisions to refuse to issue a code compliance certificate and to issue a notice to fix were correct. In deciding these matters, it must be considered:

  1. Whether the external claddings to the house (?the claddings?) comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
  2. Whether various other items identified by the authority comply with the relevant clauses of the Building Code; and whether unauthorised changes to the building work have been carried out;
  3. Whether the elements that make up the building work comply with Building Code Clause B2 Durability, taking into account the age of the house.

During the course of investigations for this determination, various changes to the consent drawings in the as-built have been identified, which are included within Matter 2.
