Description

This determination arises from the decision of the authority to refuse to issue a code compliance certificate for a 9-year-old house because it believes it cannot be satisfied that the building work complies with certain clauses of the Building Code (First Schedule, Building Regulations 1992).

In order to determine, under section 177(b)(i) of the Act, whether the decision to refuse to issue the code compliance certificate was correct it must be considered, under section 177(a), the following matters:

  1. Whether the external claddings to the house comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code;
  2. Whether the elements that make up the building work comply with Building Code Clause B2 Durability, taking into account the age of the house.
