This determination arose from the decisions of the authority to refuse to issue a code compliance certificate and to issue a notice to fix for a 5-year-old house because the building work had been undertaken under the supervision of a building certifier, which was duly registered as a building certifier under the former Building Act 1991, but which ceased operating as a certifier before it had issued a code compliance certificate for the building work.

Based on the applicant's submission, and in the absence of any submission from the authority, the matter for determination was whether the authority was correct in declining to issue a code compliance certificate.
