Description
This determination arises from the decision of the authority to refuse to issue a code compliance certificate and issue a notice to fix for a 15-year-old house because it was not satisfied that it complied with certain clauses of the Building Code.
In order to determine whether the decision to issue a notice to fix was correct, the matters for determination, in terms of sections 177 and 188 of the Act, are:
- Whether the external envelope of the house complies with Clause B2 Durability and Clause E2 External moisture of the Building Code;
- Whether certain building elements in the house, other than the claddings, comply with Building Code Clauses E1 Surface water, F4 Safety from falling, G12 Water supplies and G13 Foul water;
- Whether the building elements in the house comply with Clause B2 Durability of the Building Code, taking into account the age of the building work.
