The matter for determination is whether a 5-year old house complies with the requirements of the Building Code as required by sections 177(a) and 188 of the Act including:

  • Whether the claddings as installed on the house comply with Clauses B2 and E2. 
  • Whether the building as a whole complies with the remaining code clauses other than those contained in a certificate of acceptance issued by the authority (being Clauses B1, G12, G13, and H1).
  • Whether the building elements comply with Clause B2 “Durability” of the Building Code, taking into account the age of the building work.
