The matter for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for 3-year old additions and alterations to a house is correct. The refusal arose because the building work had been undertaken under the supervision of a building certifier which was duly registered as a building certifier under the former Building Act 1991, but which lost its approval as a building certifier before it had issued a code compliance certificate for the building work.
