Description

The matter for determination is whether the territorial authority's decision to decline to issue a code compliance certificate for a 8-year-old house because it was not satisfied that the wall cladding complied with clauses B2 Durability and E2 External Moisture of the Building Code is correct. The questions to be determined are:Issue 1: Whether the wall cladding as installed to the external walls of the building complies with the Building Code (see sections 177 and 188 of the Act). Issue 2: Whether all the building elements installed in the house, apart from those items identified in paragraph 6.3.1 as requiring to be fixed, comply with clause B2 of the Building Code considering the time that has elapsed since the elements were constructed.
