Description

The matter for determination is whether it is correct for the territorial authority to decline to issue a code compliance certificate for a 12-year-old house. The questions to be determined are: Issue 1: Whether the weatherboard cladding as installed to the walls of the building complies with the Building Code (see sections 177 and 188 of the Act). Issue 2: The additional durability considerations Whether all the building elements installed in the house, apart from those items identified in paragraph 6.3.1 as requiring to be fixed, comply with clause B2 of the Building Code considering the time that has elapsed since the elements were constructed.
