Description

The dispute for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for a 3-year-old house because it was not satisfied that the monolithic cladding to the walls of the house complied with clause E2 External Moisture of the Building Code was correct.

The question to be determined was whether the monolithic wall cladding as installed to some of the walls of the building complied with the Building Code (see sections 177 and 188 of the Act).
