Description

The matter for determination was the territorial authority's decision to refuse to issue the necessary building consents and corresponding code compliance certificate for certain proposed alterations (being fit-outs of those parts of the building leased by the tenants together with associated upgrading of the rest of the building).

That matter turned on the question of whether, after the alterations, the building would comply as nearly as is reasonably practicable with the provisions of the Building Code that relate to means of escape from fire as required by section 112 of the Act.
