Description
The dispute for determination was whether the territorial authority's decision to decline to issue a code compliance certificate for a 6-year-old house because it was not satisfied that the monolithic cladding complied with clauses B2 - Durability and E2 -External Moisture of the Building Code, was correct.
The questions to be determined were:
- Whether the territorial authority's refusal to accept the validity of a code compliance certificate for the building that was issued by a building certifier under section 56 of the Building Act 1991 should be confirmed, reversed or modified.
- Whether the monolithic wall cladding as installed to the external walls of the building, complied with the Building Code.
