Description

This is a determination of a dispute referred to the Chief Executive of the Department of Building and Housing ('the Chief Executive') under section 17 of the Building Act 1991, as amended by section 424 of the Building Act 2004.

The applicants are the trustees of the owner's family trust, and the other party is the territorial authority.

The application arises from the refusal by the territorial authority to issue a code compliance certificate for a 4-year old house, unless changes are made to its monolithic cladding system.
