This is a determination under Part 3 Subpart 1 of the Building Act 2004 made  on behalf of the Chief Executive of the Department of Building and Housing.

The applicants are the owners acting through a firm of solicitors. The other parties are the Selwyn District Council and the owners of the two neighbouring properties.

The application arises from a notice to fix under section 164 issued to the owners by the territorial authority as a result of complaints received from the neighbours to the effect that the sheds had been erected without a building consent and did not comply with the Building Code.

The determination considers, the territorial authority's decisions to:

  • (a) Refuse to issue a certificate of acceptance, and
  • (b) Issue the notice to fix.
