The application arises from the refusal by the territorial authority to issue a code compliance certificate for 7-year-old house unless changes were made to its monolithic cladding system.

The question to be determined was whether the monolithic wall cladding as installed to the timber-framed external walls of the house ("the cladding"), complied with the Building Code (see sections 18 and 20 of the Act).

"The monolithic wall cladding as installed", means the components of the system (such as the backing sheets, the flashings, the joints and the plaster and/or the coatings) as well as the way the components were installed and work together.
