This is a determination under Part 3 Subpart 1 of the Building Act 2004 made on behalf of the Chief Executive of the Department of Building and Housing.

The applicant is the apartment developer. The other parties are the Auckland City Council

The application arises from the refusal by the territorial authority to issue the third of a series of staged building consents for a multi-storey apartment block, unless changes are made to its single means of escape from fire.
