Description

This determination arises from the decision of the authority to issue dangerous building notices in respect of decks to units in 3 monolothic-clad apartment buildings.

The authority is of the view that the condition of the cantilevered timber decks and the associated wing walls mean the decks are likely to collapse and cause injury or death to persons.

There is evidence of structural decay to the decks and wing walls of some of the units caused by moisture ingress over the period of time since construction, and the authority is of the view that decks of the other units are in a similar condition.

The matter to be determined therefore is the authority's exercise of its powers of decision in issuing the dangerous building notices under section 124.
