Description

This dispute related to the authority's decision to refuse to issue a code compliance certificate for the building work, and instead to issue a notice to fix requiring the applicants apply for an amended building consent to reduce the size of the area enclosed by the pool barrier.

The matters determined were:

  1. whether the pool barrier, including the immediate pool area it encloses, complied with Clause F4 of the Building Code; and
