2015/018: Regarding the refusal to issue a building consent for an outbuilding on land that is subject to natural hazard

This determination arises from the decision of the authority to refuse to grant a building consent because:

a) the authority is of the view that the land is subject to the natural hazard inundation, and
b) the authority contends that the building consent application fails to protect the building work from the natural hazard.

The matter to be determined is therefore whether the authority was correct in its decision to refuse to grant building consent.
