Description

The determination arises from an application for a certificate of acceptance for building work carried out without consent. The authority refused to issue the certificate of acceptance on the basis that it considered it had insufficient information to establish on reasonable grounds that the building work complies with the relevant clauses of the Building Code.

The matter to be determined is whether the authority was correct to refuse to issue the certificate of acceptance for building work carried out without a building consent first being obtained.

In making this decision consideration must first to given to whether the building work required consent or was exempt building work under Schedule 1.
