Regarding the decision to issue a code compliance certificate in respect of the decks to Units 220, 221, and 237, at Terrace Downs Villas, Lake Coleridge Road, Darfield

Scope

This determination arises from issues with the weathertightness of the decks to Units 220, 221, and 237. The applicant is of the view that the decks were not constructed in compliance with certain clauses of the Building Code (Schedule 1, Building Regulations 1992). The applicant is therefore challenging the decision ofthe authority to issue code compliance certificates for work that included the decks of Units 220, 221, and 237.

The matter to be determined is therefore the exercise of the authority’s power of decision in issuing code compliance certificates for building consent No. 030544 and No. 031557, in respect of the decks to Units 220, 221, and 237. In deciding this, I must consider whether the decks were constructed to comply with the Building Code that was in force at the time of construction.

This determination is limited to the consideration of the decks of Unit 220, 221, and 237, and does not consider other matters relating to the units, or the compliance of other units in the complex.
