The application for this determination arises from the authority's decision to refuse to issue a code compliance certificate for a new house, because it did not receive a producer statement for drainage work that was not built in accordance with the approved consent. The matter to be determined is therefore whether the authority was correct in its decision to refuse to issue the code compliance certificate. In deciding this, I must consider whether the authority had reasonable grounds on which to be satisfied that the drainage work complies with Clause G13 Foul Water of the Building Code (First Schedule, Building Regulations 1992).
