Description

This determination arises due to the applicant?s proposal to remove three flights of steps and the ramp that provide access from the top of the seawall to the beach at St Clair, Dunedin, and the authority's opinion that if this were to occur the seawall would not comply with Clause D1 of the Building Code as it relates to access for people with disabilities. I therefore take the view that the matter to be determined is whether the seawall, if its steps and ramps are altered as proposed, will comply with Clause D1 of the Building Code.
