Description

This determination arises from the authority's decision to refuse to issue a code compliance certificate. The authority does not consider the work complies with Clause E2 of the Building Code. The matter to be determined is therefore whether the authority correctly exercised its powers in refusing to issue the code compliance certificate. In making this decision, I must consider: the grounds on which the authority based its decision to refuse to issue the code compliance certificate, and whether the completed building work complies with the relevant provisions of Clauses B2 Durability and E2 External moisture of the Building Code that was current at the time the building consent was issued.
