Description

The matter to be determined is therefore whether the authority was correct to refuse to issue a code compliance certificate for the work. In deciding this, the following must be considered: 1-Whether the external claddings to the cottage (the claddings) comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code; 2-Whether the building elements comply with Clause B2 Durability of the Building Code, taking into account the age of the cottage. An assessment undertaken by an independent expert commissioned by the Department to advise on this dispute (the expert), has raised the matter of alterations that appear to have been undertaken to the cottage without building consent. This determination does not consider those alterations other than in their direct impact on the claddings.
