This determination arises from the decision of the authority to refuse to issue a code compliance certificate for two 16-year-old houses constructed under one building consent because it was not satisfied that the building work complied with certain clauses of the Building Code. The authority's concerns about the compliance of the houses primarily relate to their age and weathertightness. The matter to be determined is therefore whether the authority was correct in its decision to refuse to issue a code compliance certificate for the houses. In deciding this matter the following must be considered: 1-Whether the external building envelopes of Unit A and Unit B comply with Clause B2 Durability and Clause E2 External Moisture of the Building Code; 2-Whether Unit A and Unit B comply with the other clauses of the Building Code identified by the authority; 3-Whether the building elements comply with Clause B2 Durability of the Building Code, taking into account the age of the houses.
